Factual Allegations
The ICC Office of the Prosecutor (OTP) alleges that Joseph Kony is Chairman and Commander-in-Chief of the Lord’s Resistance Army (LRA) and that Mr. Kony is, along with Vincent Otti (Vice-Chairman and Second-in-Command of the LRA) and other senior LRA commanders, a member of the “Control Altar,” which is the leadership group that conceived of, planned, and implemented LRA strategy which included campaigns to attack civilian settlements and standing orders to attack, abduct, and loot civilians.
From 2002 to 2004, as alleged by the OTP, Mr. Kony planned and implemented six separate attacks in which Mr. Kony and senior LRA commanders armed and ordered LRA forces to do the following: to attack Ugandan government forces and civilians in certain regions and internally displaced camps of Uganda; to murder civilians; to rape and inflict sexual violence against civilians; to abduct and enslave civilians including children as forced laborers, forced fighters, and sexual slaves; and to pillage and destroy property. Mr. Kony’s ordered attacks included not only murder, rape, abduction, and enslavement, but also physical mutilations and physical beatings, forced marches and forced labor under threat of death, and mass burnings and lootings of homes.

Charges
The Accused is alleged to have committed the crimes listed below as an individual, jointly with another or through another person under Article 25(3)(a) of the Rome Statute, and to have ordered, solicited, or induced the commission of these crimes under Article 25(3)(b).

The ICC Office of the Prosecutor (OTP) alleges that Okot Odhiambo was Deputy Army Commander and former Brigade Commander of Trinkle and Stockree Brigades of the Lord’s Resistance Army (LRA) and that Mr. Odhiambo was, along with Joseph Kony (Chairman and Commander-in-Chief of the LRA) and Vincent Otti (Vice-Chairman and Second-in-Command of the LRA), a member of the “Control Altar,” which is the leadership group that conceived of, planned, and implemented LRA strategy which included campaigns to attack civilian settlements and standing orders to attack, abduct, and loot civilians.
Under Mr. Kony’s orders, as alleged by the OTP, Mr. Odhiambo armed and ordered LRA forces to do the following: to attack Ugandan government forces and civilians in certain regions and internally displaced camps of Uganda; to murder civilians; to abduct and enslave civilians including children as forced laborers, forced fighters, and sexual slaves; and to pillage and destroy property.
In March 2015, the Government of Uganda exhumed a corpse which was identified through DNA testing as that of Mr. Odhiambo and certified that Mr. Odhiambo died on October 27, 2013. On September 7, 2015, Pre-Trial Chamber II terminated proceedings against Mr. Odhiambo.

The ICC Office of the Prosecutor (OTP) alleges that Raska Lukwiya was the Army Commander (third in command), former Deputy Army Commander, and former Brigade General of the Lord’s Resistance Army (LRA) and that Mr. Lukwiya was, along with Joseph Kony (Chairman and Commander-in-Chief of the LRA) and Vincent Otti (Vice-Chairman and Second-in-Command of the LRA), a member of the “Control Altar,” which is the leadership group that conceived of, planned, and implemented LRA strategy which included campaigns to attack civilian settlements and standing orders to attack, abduct, and loot civilians.
Under Mr. Kony’s orders, as alleged by the OTP, Mr. Lukwiya armed and ordered LRA forces to do the following: to attack Ugandan government forces and civilians in certain regions and internally displaced camps of Uganda; to murder civilians; to abduct and enslave civilians including children as forced laborers, forced fighters, and sexual slaves; and to pillage and destroy property.
In October 2006, at the request of the Government of Uganda and the OTP, the Netherlands Ministry of Justice-Forensics Institute reported its conclusion that the remains of the person killed on August 12, 2006 was that of Mr. Lukwiya, and the Government of Uganda provided notice that, in addition to DNA testing, there was body identification by Mr. Lukwiya’s family members and confirmation of death by LRA command. On July 11, 2007, Pre-Trial Chamber II terminated proceedings against Mr. Lukwiya.

From 2002 to 2004, as alleged by the OTP, Mr. Otti, along with Mr. Kony, planned and implemented six separate attacks in which Mr. Otti and senior LRA commanders armed and ordered LRA forces to do the following: to attack Ugandan government forces and civilians in certain regions and internally displaced camps of Uganda; to murder civilians; to rape and inflict sexual violence against civilians; to abduct and enslave civilians including children as forced laborers, forced fighters, and sexual slaves; and to pillage and destroy property. From 2003 to 2004, Mr. Otti, as alleged by the OTP, acted as “Kony’s commander of the LRA for its operations in Uganda” while Mr. Kony was in southern Sudan. Mr. Otti’s ordered attacks included not only murder, rape, abduction, and enslavement, but also physical mutilations and physical beatings, forced marches and forced labor under threat of death, and mass burnings and lootings of homes.
In January 2008, Reuters reported that South Sudan Vice President Riek Machard said that he had been informed by Joseph Kony that Vincent Otti was dead; BBC News reported that Vincent Otti may have been executed on Joseph Kony’s orders. However, as of June 2016, the OTP has not requested termination of proceedings against Mr. Otti.
